Terms of Service

These Terms of Service ("Terms") govern your use of the PicSmart platform ("Service") operated by PicSmart ("we", "us", or "our"). By using the Service, you agree to these Terms.

1. Definitions

• "Studio Admin" — The person who registers a studio and manages events, team, and settings.
• "Photographer" — Authorized personnel who upload event photos.
• "Guest" — A person who accesses event pages to find their photos via face search.
• "Client" — A photographer's client who uses the selection portal to choose photos.
• "Event" — A photo event (e.g., wedding, engagement, birthday, corporate) with associated photos.
• "PicSmart Pro" — The subscription plan granting full access to all features.

2. Eligibility

You must be at least 18 years old to create a studio account. The Service is intended for use by photo studios, photographers, and event photography businesses in India.

3. Accounts

• Studio Admins are responsible for managing their studio's account, including authorizing team members.
• You must provide accurate information when registering.
• You are responsible for maintaining the security of your Google account used to sign in.
• We reserve the right to suspend accounts that violate these Terms.

4. Photo Uploads & Content

Photographer Responsibilities

• You must have proper authorization from your clients to upload and process event photos.
• Photos must be from legitimate events. Inappropriate, offensive, or illegal content is strictly prohibited.
• You confirm that you have obtained necessary consent from subjects before uploading photos for face search processing.

Copyright

You retain ownership of all photos you upload. By uploading photos, you grant PicSmart a limited, non-exclusive license to process, store, watermark, and distribute them through the Service. This license ends when you delete the photos or your account.

Prohibited Content

You may not upload content that:

• Violates any applicable law.
• Contains nudity, violence, or other harmful material.
• Infringes on intellectual property rights.
• Contains malware or harmful code.

5. AI Face Matching

Our Service uses AI-powered face matching to help guests find their event photos. By using this feature:

• You acknowledge that face matching is automated and may not be 100% accurate.
• False matches or missed matches may occur. We are not liable for inaccuracies.
• Guest selfies are processed in real-time and not stored after matching.
• Face embeddings (mathematical representations, not actual photos) are stored per event to enable matching.

6. Subscription

• PicSmart Pro costs ₹1,499/month or ₹14,999/year.
• A 14-day free trial is available with no credit card required.
• Subscriptions are non-refundable once activated, except where required by law.
• Pricing may change with 30 days' notice.

7. Watermarks

Guest downloads include a visible watermark with studio branding. Attempting to remove, circumvent, or bypass watermarks is a violation of these Terms and may result in account suspension.

9. Limitation of Liability

To the maximum extent permitted by law:

• The Service is provided "as-is" without warranties of any kind.
• We are not liable for any indirect, incidental, or consequential damages.
• Our total liability is limited to the amount you paid for the Service in the 12 months preceding the claim.
• We are not responsible for data loss due to school account deletion or school-initiated photo removal.

10. Termination

• Schools can delete their account at any time. All photos, events, and face embeddings will be permanently deleted within 30 days.
• We may suspend or terminate accounts for Terms violations.
• Upon termination, your license to use the Service ends immediately.

11. Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Bangalore, Karnataka.

12. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or in-app notice at least 15 days before they take effect. Continued use after changes constitutes acceptance.
